Shortly after the passage of HIPAA, hew as asked to serve as the first National Health Care Fraud Coordinator for the Department of Justice (DOJ), Executive Office for U.S. Attorneys (EOUSA). In this capacity, he advised prosecutors around the country on civil and criminal health fraud statutes, schemes, investigative tools, privacy concerns, and compliance issues. He was instrumental in writing and implementing DOJ guidance on the judicious use of the False Claims Act. Robert served as Deputy Director for Legal Programs. While with DOJ, he was a  Director s Award,  the highest award that can be bestowed by the agency.

	Litigation When You Are Screwed Is Rarely Successful Due To The HCQIA of 1986 The Heath Care Quality Improvement Act of 1986, a federal law, is called a "legal carve-out" It is a most important law that is rarely if ever discussed. It states that Physicians ( MDs, DOs, DDSs and DPMs) do not have substantive or factual due process rights ( "due process rights") and only procedural due process rights or a "right" to a "Hearing" before the same folks who are prosecuting you. The Hospitals, administration, the physician leadership, etc, have almost strict immunity. Judicial review can not grant you rights that the HCQIA Law has taken away. Richard Willner will discuss an illogical law that permits " sham peer review", the blatant manufacturing of wrong evidence, and the destruction of the "disruptive physician".
